1. Who we are

Biergarten Collection is a brand of Webster Barnes LLC, 151 Harbors Way, Boynton Beach, Florida 33435, United States. Webster Barnes LLC is the controller of the personal information described in this statement.

This statement covers the website biergartencollection.com and any pages, forms and features on it (the “Site”). It does not cover other websites we operate under separate brands, or third-party sites we link to.

Privacy contact: privacy@websterbarnes.com

2. The short version

  • We are an importer and marketer of beer. We do not sell anything directly to consumers on this Site, and we do not take payment on it.
  • We collect personal information in two places only: when you send us an inquiry through our contact form, and when you give us your email address to vote for your favorite beer.
  • We collect ordinary technical information automatically, and we use cookies. Non-essential cookies run only if you allow them in our cookie banner.
  • We do not sell your personal information, and we do not share it for cross-context behavioral advertising.
  • The Site is intended for people of legal drinking age. It is not directed to children.

3. Information we collect

3.1 Information you give us

Contact and trade inquiries. If you use a contact or inquiry form, we collect your name, email address, company or business affiliation where you give it, and whatever you choose to put in the message. Providing this is voluntary, but we cannot answer an inquiry without a way to reach you.

Favorite beer vote. If you take part in a vote or poll on the Site, we collect your email address and the selection you make. We use the email address to make sure each person votes once, and to contact you about the vote if that is necessary. We will only add you to a marketing list if you separately and affirmatively ask us to.

Anything else you choose to send us. If you email, write or call us, we keep a record of the correspondence.

3.2 Information we collect automatically

When you visit the Site we and our service providers automatically receive:

  • your IP address and approximate location derived from it (city or region level, not a precise location);
  • your browser type and version, operating system, device type, and screen or window size;
  • the referring page, the pages you view on the Site, and the dates and times of those visits;
  • basic diagnostic and error information.

3.3 Cookies and similar technologies

A cookie is a small file placed on your device when you visit a website. We use a consent management platform to categorize cookies and to record your choices.

  • Functional / strictly necessary — required for the Site to work (page delivery, security, and remembering your cookie choices). These run without consent because the Site cannot function without them.
  • Preferences — remember choices such as language or display settings.
  • Statistics — help us understand how the Site is used in aggregate.
  • Marketing — would allow advertising or social media partners to build a profile of your interests.

Preferences, statistics and marketing cookies are off by default and are set only if you accept them. You can change or withdraw your choice at any time using cookie settings, and you can also block or delete cookies in your browser.

3.4 What we do not collect

We do not collect payment card numbers, government identification numbers, precise geolocation, biometric data, or the special categories of data defined in Article 9 of the GDPR. We do not ask you for, and do not want, sensitive personal information.

4. How we use personal information, and our legal basis

We do not make decisions producing legal or similarly significant effects about you by automated means, and we do not carry out profiling of that kind.

5. How we disclose personal information

We disclose personal information only in these circumstances:

  • Service providers. Our website host, email provider, form and consent-management tools, and IT and security providers, who process it on our instructions and for no purpose of their own.
  • Affiliates. Other Webster Barnes group companies, where they need it to answer your inquiry or support the brand.
  • Legal and regulatory. Where we are required to disclose it by law, court order, or a lawful request from a public authority, or where disclosure is necessary to establish, exercise or defend legal claims.
  • Business transfer. If all or part of our business is sold, merged or reorganized, information may transfer as part of that transaction. We would tell you before your information became subject to a materially different privacy statement.

We do not sell personal information, and we have not sold personal information in the preceding twelve months. We do not share personal information for cross-context behavioral advertising or targeted advertising, and we do not process it for those purposes.

6. International transfers

We are based in the United States, and our service providers are mostly in the United States and the European Union. If you are in the European Economic Area, the United Kingdom or Switzerland, your personal information will be transferred to the United States, which has not received an adequacy decision of general application.

Where we make such a transfer, we rely on the Standard Contractual Clauses adopted by the European Commission (and the UK Addendum or UK International Data Transfer Agreement for the United Kingdom), together with any supplementary measures required. You may request a copy of the relevant safeguards by writing to privacy@websterbarnes.com.

7. How long we keep it

  • Inquiries: for as long as needed to deal with the inquiry, and then up to 24 months, so we can pick up the thread if you contact us again.
  • Vote and poll data: the email address is deleted within 6 months of the vote closing. The aggregate result is kept indefinitely and contains no personal information.
  • Marketing list: until you unsubscribe, and then a minimal suppression record so we do not contact you again.
  • Server and security logs: typically 12 months.
  • Records we must keep by law: for the period the relevant law requires.

8. Security

We maintain physical, technical and organizational measures designed to protect personal information against loss, misuse, and unauthorized access, disclosure or alteration. These include access controls, encryption in transit, and limiting access to people who need it.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach affects your personal information and the law requires us to notify you, we will.

9. Your rights

9.1 If you are in the EEA, the UK or Switzerland

You have the right to: access your personal information; have it corrected; have it erased; restrict or object to our processing of it, including objecting at any time to processing based on legitimate interests; receive it in a portable form; and withdraw consent at any time, without affecting the lawfulness of processing carried out before you withdrew it.

You also have the right to lodge a complaint with your national supervisory authority. In France that is the CNIL (cnil.fr); in the United Kingdom, the ICO (ico.org.uk). We would appreciate the chance to address your concern first.

9.2 If you are in California

Under the California Consumer Privacy Act as amended by the CPRA, you have the right to know what personal information we collect, use and disclose; to access it and receive a copy; to have it corrected; to have it deleted; to opt out of sale or sharing; to limit the use of sensitive personal information; and not to be discriminated against for exercising any of these rights.

We do not sell or share personal information and do not use sensitive personal information for purposes requiring a limitation right, so the opt-out and limitation rights have nothing to act on here. We honor the Global Privacy Control signal as an opt-out request regardless.

The categories in Section 3 map to the CCPA categories of identifiers, commercial information (only in the sense of your inquiry), and internet or other electronic network activity information. We collect them from you and from your device, use them for the purposes in Section 4, and disclose them only to the recipients in Section 5.

9.3 If you are in another US state with a privacy law

Residents of states including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Florida, Iowa, Delaware, New Hampshire, Nebraska, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky and Rhode Island have comparable rights to access, correct, delete and port their personal information, and to opt out of sale and targeted advertising. We extend the rights in this section to every US resident who asks, whether or not the law in their state requires it of us.

Where a state law provides an appeal from our decision on a request, you may appeal by replying to our response or writing to privacy@websterbarnes.com with “Appeal” in the subject line. We will respond to an appeal within the time the applicable law allows, and will tell you how to contact your state attorney general if you remain dissatisfied.

9.4 How to exercise a right

Write to privacy@websterbarnes.com, or to Webster Barnes LLC, 151 Harbors Way, Boynton Beach, Florida 33435, USA, Attention: Privacy.

We will respond within one month (EEA/UK) or within 45 days (US states), and may extend that period where the law allows, in which case we will tell you. We may need to verify your identity before acting, usually by confirming control of the email address in our records. We do not charge for this, unless a request is manifestly unfounded or excessive.

An authorized agent may make a request on your behalf with written proof of authority, and we may ask you to confirm it directly.

10. Age of the audience

This Site is about alcoholic beverages and is intended only for people who are of legal drinking age where they live — 21 or over in the United States. Please do not use the Site, submit a form or enter a vote if you are under that age.

The Site is not directed to children. We do not knowingly collect personal information from anyone under 13, or from anyone under the legal drinking age in their jurisdiction. If you believe a child has given us personal information, write to privacy@websterbarnes.com and we will delete it.

The Site links to other websites, including websterbarnes.com and the sites of our brewing partners, retailers and social platforms. We are not responsible for their content or privacy practices, and this statement does not apply to them. Read their own privacy statements before giving them information.

12. Changes to this statement

We may update this statement. When we do, we will change the effective date at the top. If a change materially affects how we use personal information we already hold, we will give notice on the Site, and where the law requires it, we will ask for your consent.
